- Oddbins Wine Auctions (Australia) Pty Ltd acts as agents for the vendor of each lot.
- The highest bidder on any lot will be the buyer subject to any reserve price. The
auctioneer may bid on behalf of the vendor up to the reserve price and may withdraw any
lot from sale.
- The auctioneer can advance the bidding at his discretion.
- The auctioneer may refuse to accept the bid or bidding of any person or persons, without
giving any reason.
- The auctioneer will settle any disputes arising out of the bidding, provided such
dispute occurs before the next lot is offered, and may re-offer the lot or name the buyer
at his option.
- All lots are sold as catalogued and the sale shall not be invalidated by reason of any
defects or faults or incorrect description.
- Each lot shall be at the buyers risk from the fall of the hammer.
- The auctioneer may request a deposit or the whole of the purchase price on the fall of
the hammer in cash or by bank cheque. Failure to comply may result in the lot being
re-offered.
- No lots shall be taken without prior payment and all lots must be removed by the time
stated by the auctioneer.
- Payment at live auctions must be made either on the night of the auction during the
times stated by the auctioneer or by 12 noon on the morning following the auction. Payment
for silent bid auctions and absentee bids must be made within 5 days of receipt of
invoice. All payment must be by cash, bank cheque, Mastercard, Bankcard, Visa or direct
transfer, unless otherwise agreed with the auctioneer prior to the auction.
Title to the goods shall not pass to the buyer until all payments are cleared by the
auctioneers bank.
The buyer need not sign the sales ledger but the auctioneers clerk shall sign the
same and other necessary documents as the buyers agents without further authority or
consent from the buyer from this condition.
- Sales tax or licence fee where applicable shall be paid by the buyer.
- Failure to comply with these conditions may result in the forfeit of deposit or the
re-offering of any lot at such time and place as may be convenient for the auctioneer and
any loss on re-sale shall be a debt due by the purchaser or defaulter at this sale to the
seller.
